Cicayda, L.L.C. (“we” and/or “us” and/or “our” and/or “Company”) are committed to complying with all applicable laws intended to protect your right of privacy. This Privacy Policy describes (i) the type of information about you that we collect; and (ii) our practices with respect to gathering and disseminating information about you. This Privacy Policy was established within the context of the potential for gathering personal information within electronic media; however, this Policy is not limited to our Website. Our Privacy Policy applies whenever you interact with us and there is a possibility that during such interaction, we may acquire certain information about you. This Privacy Policy does not create any contractual obligations on the part of the Company.

It is our policy to allow you to choose what personal information you provide to us. You do not have to provide any information about yourself to enjoy the Site, but if you so choose, you will be required to share certain information with us.

From time to time, we may ask customers to provide personal information that will help us efficiently perform various transactions. That information may be sought as you: register for general information; register for a free trial or demonstration of certain products and services; sign up or subscribe to products and services; participate in a special offer or contest.

We only collect personal information – names, addresses, phone numbers, email addresses or credit card numbers – about you when you specifically provide such information on a voluntary basis. We do not store your credit card information, as our credit facility handles all credit card data and transactions. We may utilize your personal information in several discrete ways. If you are purchasing a membership or merchandise, we utilize your personal information to communicate with you about your ticket order or ticket inquiry. Also, as is always the case whenever you make a purchase, we, as well as any related providers, are entitled to know the information you give us. We have no control whatsoever over the other providers’ use of that information. Your personal information provided to us may be shared with our related providers and used in accordance with their standard policies.

We may occasionally contact you, typically by email (or any other way you prefer) in order to notify you of special promotions, new content, or other happenings at cicayda. Of course, if you do not wish to receive this personalized information, you can always let us know by e-mailing us and we will happily abide by your wishes. Notwithstanding the foregoing, we reserve the right to contact you, utilizing your personal information, to inform you of information that might affect you.

We may use your Internet Protocol (IP) address to help diagnose problems with our computer server, and to administer our web site. Your IP address is used to help identify you, and to gather broad demographic data. Your IP address contains no personal information about you.

We may analyze customer usage in order to measure interest in, and use of, the various parts of the web site, and we may share that information prospective advertisers, and other interested third parties. But, this information is aggregated data only, and contains no personally identifiable information whatsoever.

Users should be aware that non-personal information and data may be automatically collected by virtue of the standard operation of the pertinent computer servers or through the use of “cookies”. Cookies are files a web site can use to recognize repeat users, and allow a web site to track web usage behavior. Cookies take up minimal room on your computer and cannot damage your computer’s files. Cookies work by assigning a number to the user that has a specific meaning to the assigning web site. Cookies, by themselves, cannot be used to find out the identity of any user. Unless you choose to provide us with information about you, we will never know who you are, even though we assign your computer a cookie. If you do not want information to be collected through the use of cookies, your browser allows you to deny or accept the use of cookies. There may, however, be some features on the web site that require the use of cookies in order to customize the delivery of information to you.

We reserve the right to share, sell, or rent your personal identifying information to any third parties at this time, except not any credit card information you give when making a purchase.

The Company maintains data security systems that protect specific individual information such that it will not be made available to any unauthorized person. We use a security system to control access to information stored for our customers. This is complemented with physical security at facilities.

Data Protection and Privacy legislation was originally developed in Europe and now exists in many countries worldwide. We are committed to adhering to the relevant data protection legislation and/or industry codes of practices.

1. How and When Does cicayda Collect Non-Public Personal Information?

In the course of membership registration and/or selling memberships, tickets, or merchandise, we may collect and maintain certain nonpublic personal information that will help us to efficiently perform various transactions. In addition, we may be required to share your personal information with certain other organizations as part of our contractual relationship with them. We do not collect personal information about you except when you specifically provide your information on a voluntary basis.

2. How and When Does cicayda Use Non-Public Personal Information?

We may utilize your personal information in several discrete ways. If you are making a purchase, we utilize your personal information to complete the purchase transaction and to communicate with you about your order, delivery or other inquiry.

In addition, whenever you make a purchase, we may be required to share your personal information with a third party credit card processor to facilitate completion of your transaction. The credit card processor may share the same information with your credit card issuer for the issuer’s use in connection with gathering data related to use of their cards, rewards programs or other purposes. You are urged to read and become familiar with the privacy policies governing the use of your credit cards. Also, when you make a purchase, we may be contractually required to pass your personal information to others so that they may communicate with you about your purchase. Under those circumstances, we cannot offer you the option to opt-out from having your information passed to on to others who help fulfill your purchase request. These others are not subject to the provisions of this Privacy Policy, which means that they may use your personal information unless you contact them and request otherwise. The Company has no control over the use of your personal information by any other entities and you agree that we are not liable for any use of your personal information by them. If you have special preferences concerning use of your personal information by other entities, you must communicate those preferences directly to them. When you visit our Website, we may also gather certain information about the use of your computer that we aggregate with similar information collected from other visitor’s computers, which we use for statistical and other purposes (see “Aggregate Information” described in Section 4 below). Finally, we may occasionally contact you, typically by email, to notify you of information that might affect your event experience, or to notify you of event cancellations, or errors in your order. Additionally, we may contact you regarding offerings of future events, products or services that may be of interest to you. If you are not interested in receiving email notices or advertisement from us, you can unsubscribe at any time.

3. How Long Is Your Personal Information Retained?

If you are a registered user of our Website, we may retain your information as long as you maintain your registered status. If you purchase tickets or other merchandise using a credit card, we will retain your credit card information for a length of time reasonably necessary to process any future transactions related to your purchases, including refunds and charge backs. We occasionally purge our computer system of information relating to visitors of our Website and their past transactions.

4. What Is “Aggregate Information” and What Does cicayda Do with It?

Typically, as visitors browse our Website, our computers automatically collect information related to how certain features of our Website are used, what general region our visitors are contacting us from and how many people visit our Website at any given time. We only use this information in the aggregate, which means that we only derive meaning from the sum of all such information gathered for a period of time and accordingly, we refer to this information as “Aggregate Information”. Aggregate Information includes, but is not limited to your computer’s (i) Internet browser type, (ii) IP address, (iii) resolution settings, (iv) platform type, and (v) originating URLs of referring web pages. We use Aggregate Information to (a) help diagnose problems with our computers, (b) administer our Website, (c) share certain generalized demographic information with Event Hosts and our advertising partners about visitors of our Website, and (d) provide our advertising partners with information regarding which visitors saw and clicked on certain advertisements on our Website. Aggregate Information does not contain any personal information of any of our Website visitors.

5. What Are “Cookies” and How Does cicayda Use Them?

The term “Cookie” is a nickname for files that a website’s computer system can deposit onto a visitor’s computer hard drive when the visitor is logged on to the website. Cookies are used to recognize a visitor’s repeat visits to the website and what pages are accessed and what functionalities are used while he or she is there. The use of cookies is commonplace on the Internet and they take up minimal room on your computer hard drive. Cookies work by assigning a number to your computer that has a specific meaning to the assigning website. Cookies, by themselves, cannot be used to find out the identity of any visitor. Unless you choose to provide us with information about you, we will never know who you are, even though our computer has previously deposited a cookie on your computer’s hard drive. Other companies that advertise on our Website also have the ability to deposit a different cookie on your computer’s hard drive in a process that we do not control. Since cookies aren’t useable for identifying individuals (i.e., we will not store non-public personal information in a cookie), these advertisers will never know who you are. In addition, you may modify your Internet browser’s settings to notify you whenever any website is going to deposit a cookie on your computer’s hard drive. This notification option generally gives you the opportunity to decide whether to accept or refuse a cookie before it is deposited. There may be some features on our Website, however, that require a cookie to operate correctly. For example, to become a registered user of our Website, you must allow us to deposit a cookie on your computer’s hard drive.

6. Consent/Choice Statement – Non-Vermont Computer Users.

We may sell or rent personal information about our on-line customers to any third parties. Vermont places additional restrictions on sharing a user’s personal information while such user resides in Vermont. We will not rent or sell non-public personal information we collect from a user residing in Vermont except (1) as permitted by law or (2) with the express authorization or consent of the Vermont User.

7. Data Quality and Security Statement.

We use data security systems to encrypt your personal and financial information to reduce the risk that your information will be obtained by unauthorized persons. Our electronic security measures are complemented by the physical security of our facilities and limited access to certain critical areas, such as our computer locations. However, because of the increasing sophistication of computer hackers and others who would seek to invade our computer systems for the purpose of stealing information, damaging our systems or denying our systems’ ability to operate effectively to safeguard personal and financial information as intended, we make no promises as to the security of personal or financial information in our possession or the impenetrability of our computer systems under unusual circumstances or our computer system’s resilience to future sophisticated attacks.

8. When Might Information Be Disclosed as a Matter Of Law?

We may disclose non-public personal information to unrelated parties in special cases when we have reason to believe that disclosure is necessary to identify, contact, or bring legal action against a person or persons who may be causing injury to, or interference with, the rights or property of cicayda, computer users accessing our Website, or any third party. In addition, we may disclose information about individuals who access our Website to law enforcement agencies, judicial or government authorities, or to other individuals or entities in response to subpoenas, court orders, or other legal processes.

9. Links To / From Other Sites

Our Website contains links to other Internet websites which we do not operate and, conversely, other Internet websites may contain links to our Website. We are not aware of and are not responsible for the privacy policies, practices, or content of such other websites. We encourage visitors to read and become familiar with the privacy policies maintained by such other websites.

10. Information of Minors & Children.

We do not target our Website or our products or merchandise for sale on our Website to children, and our Website does not seek to collect contact information from children under the age of 18.

Safe Harbor Privacy
cicayda adheres to the U.S.–E.U. Safe Harbor Framework and the U.S.–Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data from our subsidiaries, corporate customers, and other business partners in the E.U.ropean Union member countries and Switzerland.

What You Consent to by Using Our Site

Please understand that by submitting any Personally Identifiable Information to us, you consent and agree that we may collect, use and disclose such Personally Identifiable Information in accordance with this Privacy Policy and our TOS and end user licensing agreement., and as permitted or required by law.

What Information we Collect

We gather two types of information about users through the Site:

Non-Personal Information

When users come to our site, we may track, collect and aggregate Non-Personal Information indicating, among other things, which pages of our Site were visited, the order in which they were visited, when they were visited, and which hyperlinks were “clicked.”

You should be able to control how and whether cookies will be accepted by your web browser. Most browsers offer instructions on how to reset the browser to reject cookies in the “Help” section of the toolbar. If you reject our cookies, many functions and conveniences of this Site may not work properly.

Personally Identifiable Information

We collect Personally Identifiable Information that you provide to us when you register for an account, update or change information for your account, purchase products or services, complete a survey, sign up for email updates, participate in our public forums, send us email messages, or other services on our Site. We may use the Personally Identifiable Information that you provide to respond to your questions, send you updates about services offered by cicayda or our events, and send you email messages about Site maintenance or updates.

Account Registration

If you register for an account on our Site, you may be required to provide us with Personally Identifiable Information such as your name and email address.

Third Party Credit Card Processing

cicayda provides you with the ability to pay for services using a credit card through a third party payment processing service provider. Please note that our service provider – not cicayda – collects and processes your credit card information.

cicayda’s approach to privacy:
Non-Personal Information

We use Non-Personal Information to build higher quality, more useful services by performing statistical analyses of the collective characteristics and behavior of our users, and by measuring demographics and interests regarding specific areas of our Site. We may also use it for other business purposes.

Personally Identifiable Information

Except as set forth in this Privacy Policy or as specifically agreed to by you, cicayda will not disclose any Personally Identifiable Information we gather from you on the Site. In addition to the other uses set forth in this Privacy Policy, we may disclose and otherwise use Personally Identifiable Information as described below. We may also use it for research and business purposes, including improving and customizing the Site and the products and services we offer.

Updates

We use Personally Identifiable Information collected when you sign up for our various email or update services to send you the messages in connection with the Site. We may also archive this information and/or use it for future communications with you.

Disclosure to cicayda Operations and Maintenance Contractors

We use various service providers, vendors and contractors (collectively, “Contractors”) to assist us in providing our products and services to you. Our Contractors may have limited access to your Personally Identifiable Information in the course of providing their products or services to us, so that we in turn can provide our products and services to you. These Contractors may include vendors and suppliers that provide us with technology, services, and/or content related to the operation and maintenance of the Site. Access to your Personally Identifiable Information by these contractors is limited to the information reasonably necessary for the contractor to perform its limited function for us.

Safe Harbor Privacy Statement

For personal information about our customers subject to E.U. data protection laws that we receive from Member States of the E.U.ropean Union, cicayda is committed to handling such personal information in accordance with the Safe Harbor Principles. cicayda’s Safe Harbor certification can be found at our website (http://cicayda.com). Additional information about the Safe Harbor program is available at the U.S. Department of Commerce’s website at http://www.export.gov/safeharbor.

Children

cicayda’s websites are not intended for use by Minors & Children under the age of 18. We do not knowingly solicit data online from, or market online to, children under the age of 18. If we learn that we have obtained personally identifiable information online in error about a child under the age of 18, we will delete that information as soon as we can.

External Links

For your convenience we may provide links to sites operated by organizations other than cicayda (“Third Party Sites”) that we believe may be of interest to you. We do not disclose your Personally Identifiable Information to these Third Party Sites without obtaining your consent. We do not endorse and are not responsible for the privacy practices of these Third Party Sites. If you choose to click on a link to one of these Third Party Sites, you should review the privacy policy posted on the other site to understand how that Third Party Site collects and uses your Personally Identifiable Information.

Confidentiality & Security of Personally Identifiable Information

We consider the confidentiality and security of your information to be of the utmost importance. We will use industry standard physical, technical and administrative security measures to keep your Personally Identifiable Information confidential and secure and will not share it with third parties, except as otherwise provided in this Privacy Policy, or unless we have a good faith belief that such disclosure is necessary in special cases, such as a physical threat to you or others. Because the Internet is not a 100% secure environment we cannot guarantee the security of Personally Identifiable Information, and there is some risk that an unauthorized third party may find a way to circumvent our security systems or that transmission of your information over the Internet will be intercepted. It is your responsibility to protect the security of your login information. Please note that e-mails and other communications you send to us through our Site are not encrypted.

Updating or Deleting Your Personally Identifiable Information

You can access your Personally Identifiable Information and confirm that it remains correct and up-to-date or choose whether or not you wish to receive material from us or some of our partners by logging into the Site and visiting your user account page. You may also contact us via feedback@cicayda.com. We try to answer every email promptly, but may not always be able to do so. Keep in mind, however, that there will be residual information that will remain within our databases, access logs and other records, which may or may not contain your Personally Identifiable Information.

International Privacy Practices

cicayda’s websites, including websites directed to residents in countries and jurisdictions outside of the United States are operated and managed on servers located and operated within the United States or the UK (for data generated in the E.U.). Regardless where the data originated, all customer data subject to this policy receives the same level of privacy protection as described in this policy statement.

By using and accessing our sites, residents and citizens of countries and jurisdictions outside of the United States agree and consent to the transfer to and processing of personal information on servers located in the United States or the UK (for data generated in E.U.), and that the protection of such information may be different than required under the laws of your residence or location.

Changing Our Privacy Policy

Please note that we review our privacy practices from time to time, and that these practices are subject to change. Scope:

cicayda has developed the following privacy policy to protect individually identifiable information. This policy covers cicayda and applies to all individually identifiable information that cicayda obtains when a client uses a cicayda service.

cicayda protects individually identifiable information as follows:

This cicayda Safe Harbor Privacy Policy describes how we handle personal information (1) collected by cicayda subsidiaries, our corporate customers, and other business partners located in the E.U. and Switzerland, which is then transferred to cicayda in the United States; and (2) received from companies that use one of cicayda’s hosted services who operate in the E.U. and Switzerland and processed by cicayda in the United States on behalf of the company. This Safe Harbor Privacy Policy supplements the cicayda Privacy Policy.

When we collect Personal Information (as defined below) from you, we adhere to the U.S.-E.U. Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use and retention of Personal Information from E.U.ropean Union member countries and Switzerland. Accordingly, we follow the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access and enforcement (collectively, the “Principles”). When we use the term “Personal Information” in this Safe Harbor Policy (the “Policy”), we are referring to any information that (i) is recorded in any form; (ii) is about or is related to a specific individual; (iii) can be linked to that individual; and (iv) is transferred by us from the E.U. and Switzerland to the U.S.

When we use the term “Sensitive Personal Information” in this Policy, we are referring to a particular subset of an individual’s Personal Information that provides details of his or her race, ethnic origin, sexual orientation, political opinions, religious or philosophical beliefs, trade union membership or that concerns his or her health.

The purpose of this Policy is to outline our general practices for implementing the Principles with respect to the Personal Information we collect. Information collected by cicayda subsidiaries, corporate customers and business partners

Personal information

cicayda may receive personal information from cicayda subsidiaries, our corporate customers, and other business partners in the E.U. and Switzerland, such as name, email address, company name, title, postal address, telephone number, and preferences regarding our applications and websites. Any personal information sent to us may be used by cicayda and its subsidiaries and their agents and business partners for the purposes described at the time the information was collected. If you agree to receive email or telephone marketing from us, personal information we receive will also be used for those purposes, as described in the cicayda Privacy Policy. If we plan to use personal information for a purpose that is incompatible with these purposes or if we plan to disclose personal information to a kind of company not described here, we will seek your consent to such uses or disclosures.

Agents and service providers

cicayda works with several companies to help us deliver our services to you on our behalf. These companies are not permitted to use your information for their own purposes. cicayda requires that its agents and service providers that have access to personal information received by cicayda from the E.U. or Switzerland subscribe to the Safe Harbor Privacy Principles, be subject to the E.U. Privacy Directive or enter into a written agreement that requires them to provide at least the same level of privacy protection as is required by the relevant Safe Harbor Principles.

Security

cicayda uses reasonable physical, electronic, and administrative safeguards to protect your personal information from loss, misuse, or unauthorized access, disclosure, alteration, or destruction.

Data integrity

cicayda takes reasonable steps to ensure that your personal information we process is accurate, complete, and current by using the most recent information provided to us.

Accessing and updating your information

You can request to review, update, or delete your personal information.

Information processed by cicayda on behalf of a company using a cicayda hosted service

cicayda provides hosted services to companies. As part of providing these hosted services, cicayda may receive and process your personal information if you are a customer of one of these companies. When cicayda provides these services, we are referred to as a data processor. As a data processor, cicayda acts on the instructions of these companies and uses reasonable physical, electronic, and administrative safeguards to protect this personal information from loss; misuse; or unauthorized access, disclosure, alteration, or destruction. Companies that use a cicayda hosted service are responsible for complying with all other obligations in relation to the personal information they may collect from you.

Principles
1. Notice

We will provide you with timely and appropriate notice in our Terms of privacy, describing what Personal Information we are collecting, how we will use that information, and the types of third parties with whom we may share such information.

2. Choice

We will offer you the opportunity to opt out of your Personal Information (or explicitly consent for Sensitive Personal Information) being: (i) disclosed to a third party (other than a service provider as set forth below); or (ii) used for a purpose other than the purpose for which it was originally collected (or subsequently authorized by you) when the circumstances arise.

3. Onward Transfers (Transfer to Third Parties)

We will only transfer Personal Information to third parties where the third party: (i) has provided satisfactory assurances to us that it will protect the Personal Information in accordance with this Policy and the substance of the Principles; (ii) is located in the ., Switzerland or a country considered “adequate” for privacy by the E.U. Commission and/or the Federal Data Protection and Information Commissioner of Switzerland, and therefore is required to comply with the E.U. or Swiss data protection laws or substantially equivalent privacy laws; or (iii) has certified to the Safe Harbor, and is accordingly independently responsible for complying with the Safe Harbor requirements.

4. Data Security

We will take reasonable steps to protect Personal Information from loss, misuse and unauthorized access, disclosure, alteration and destruction. We have implemented appropriate physical, electronic and managerial procedures to help safeguard and secure Personal Information from loss, misuse, unauthorized access or disclosure, alteration or destruction. cicayda will not sell, trade, or disclose to third parties any individually (either client or cicayda employee) identifiable information, derived from the use of any cicayda service

5. Data Integrity

We will process Personal Information in a manner that is compatible with and relevant to the purpose for which it was collected or authorized by you. To the extent necessary for those purposes, we will take reasonable steps to ensure that Personal Information is accurate, complete, current and reliable for its intended use. cicayda has implemented technology and security features and strict policy guidelines to safeguard the privacy of identifiable information from unauthorized access or improper use, and we will continue to enhance our security procedures as new technology becomes available.

6. Access

Upon request, we will provide you with reasonable access to the Personal Information about you that we hold. We will also take reasonable steps to correct, update, amend or delete any information that is demonstrated to be inaccurate, except where the burden or expense of doing so would be disproportionate to the risks to your privacy in the case in question or where the rights of third parties would be violated.

7. Enforcement

cicayda periodically verifies that the policy is accurate, comprehensive for the information intended to be covered, completely implemented, and in conformity with the Safe Harbor Principles. We will regularly review our compliance with the statements set forth in this Policy, and we will provide an independent way to resolve complaints about our privacy practices. We encourage interested persons to Contact (feedback@cicayda.com.) and we will investigate and attempt to resolve any complaints and disputes regarding use and disclosure of Personal Information in accordance with the Principles. We also participate in the International Centre for Dispute Resolution (“ICDR”), a division of the American Arbitration Association’s, & Dispute Resolution Process. This policy may be changed from time to time as permitted under the Safe Harbor program.
